1. About Tri-County Trading
Tri-County Trading is an online marketplace that connects buyers with independent sellers and small businesses. We provide the platform that allows vendors to list and sell products but are generally not the seller of items offered by independent vendors unless specifically identified as such.
2. Eligibility
You must be at least 18 years old or have the permission of a parent or legal guardian to use this website.
By creating an account, you agree that the information you provide is accurate and kept up to date.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials.
You agree to:
- Provide accurate information.
- Keep your password secure.
- Notify us immediately if you believe your account has been compromised.
- Accept responsibility for activity that occurs under your account.
4. Vendor Accounts
Vendors are responsible for:
- Providing accurate product descriptions.
- Setting prices.
- Maintaining inventory.
- Shipping orders promptly.
- Responding to customer inquiries.
- Complying with applicable federal, state, and local laws.
Vendors represent that they have the legal right to sell all products they list.
5. Prohibited Products
The following may not be listed or sold through Tri-County Trading:
- Illegal products or services.
- Stolen goods.
- Counterfeit merchandise.
- Hazardous or unsafe materials.
- Products that infringe on copyrights, trademarks, or other intellectual property rights.
- Adult or obscene materials prohibited by law.
- Any item prohibited by applicable law.
- Any of the items on our Unacceptable Items Listing
We reserve the right to remove listings at our discretion.
6. Orders and Payments
Orders placed through the marketplace are agreements between the buyer and the vendor.
Payments are processed through secure third-party payment providers.
Tri-County Trading is not responsible for payment processing delays caused by third-party providers.
7. Shipping
Vendors are responsible for packaging and shipping their products unless otherwise stated.
Estimated shipping times are provided as a convenience and are not guaranteed.
8. Returns and Refunds
Each vendor may maintain their own return and refund policy unless otherwise required by law.
Buyers should review a vendor’s policies before making a purchase.
If a dispute cannot be resolved directly between the buyer and vendor, Tri-County Trading may, at its discretion, assist in facilitating communication but is not obligated to resolve disputes or issue refunds.
9. Marketplace Content
Product descriptions, photographs, pricing, and other listing information are provided by individual vendors.
While we encourage accuracy, Tri-County Trading does not guarantee the completeness or accuracy of vendor-provided information.
10. Intellectual Property
The Tri-County Trading name, logo, website design, and original content are the property of Tri-County Trading unless otherwise noted.
Vendors retain ownership of the content they submit but grant Tri-County Trading a non-exclusive license to display and promote their listings as necessary to operate the marketplace.
11. Acceptable Use
You agree not to:
- Use the website for unlawful purposes.
- Attempt unauthorized access to any part of the website.
- Upload malicious software or harmful code.
- Interfere with the operation or security of the marketplace.
- Harass, threaten, or abuse other users.
12. Account Suspension or Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms.
- Engage in fraudulent activity.
- Repeatedly receive substantiated customer complaints.
- Harm the operation or reputation of the marketplace.
13. Disclaimer of Warranties
The marketplace is provided “as is” and “as available.”
We make no guarantees regarding uninterrupted service, error-free operation, or the accuracy of vendor listings.
14. Limitation of Liability
To the fullest extent permitted by law, Tri-County Trading shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the marketplace.
Our total liability for any claim related to the website shall not exceed the amount paid to us by the user during the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
15. Indemnification
You agree to indemnify and hold harmless Tri-County Trading, its owners, employees, and affiliates from claims, damages, or expenses arising from your use of the marketplace, your listings, or your violation of these Terms.
16. Changes to These Terms
We may update these Terms from time to time. If we do, we will send you notification of changes. Continued use of the website after changes become effective constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.
